Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Bennet Ngan, operating as Aurum (“Aurum”, “we”, “us”). By creating an account, starting a free trial, or otherwise using the Aurum service (the “Service”), you agree to these Terms.

If you don’t agree, don’t use the Service. If you’re using Aurum on behalf of another person or organization, you represent that you have authority to bind that party to these Terms.

You may use Aurum if all of the following are true:

• You are at least 13 years old (or, if you live outside the United States, at least 18).
• You can form a legally binding contract under the laws of your jurisdiction.
• You haven’t been previously suspended from the Service for cause.

We may, at our discretion, restrict access in jurisdictions where the Service can’t be lawfully provided.

You provide an email address and either set a password or sign in via a supported provider (currently Google). You’re responsible for keeping your credentials confidential and for everything that happens under your account. Tell us promptly at support@aurumwealth.io if you suspect unauthorized access.

You agree to provide accurate information and to keep it current. Each account is for a single person; sharing one account between multiple people isn’t permitted.

Aurum is offered as a paid subscription with two tiers: Personal and Pro. Pricing is shown on the pricing page at the time of purchase. Fees are charged in advance: monthly plans bill every month, annual plans bill the full year up front.

Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, unless you cancel before the renewal date. You authorize us, through our payment processor Stripe, to charge your selected payment method for the applicable fees.

Refund and cancellation rights are governed by our Refund & Cancellation Policy.

New accounts begin with a 30-day free trial. We don’t require a credit card to start the trial. Toward the end of the trial we’ll ask whether you’d like to subscribe; if you don’t, your account moves into a read-only state and you keep access to the data you’ve already entered.

We may offer different trial terms in promotions or for cohort programs. Where the promotional terms differ from these defaults, the promotional terms control.

We may change prices at any time. Price changes don’t affect the current billing period; for monthly plans they take effect on the next renewal, for annual plans on the next yearly renewal. We’ll notify you at least 30 days in advance of a price increase by email and in the app.

Grandfathering commitment. If you joined Aurum during the public pre-launch beta or as a founding subscriber, your current rate is locked in for as long as your subscription remains continuously active. Future general price increases won’t apply to you unless you let your subscription lapse, change plans, or change billing cycle. We document this commitment publicly because we intend to honor it.

You agree not to:

• Reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service.
• Scrape, crawl, or use automated tools to extract data from the Service except as expressly permitted by Aurum.
• Probe, scan, or test the vulnerability of the Service or attempt to bypass its security.
• Interfere with the Service’s operation, including by overloading it, sending malicious requests, or impersonating another user.
• Use the Service to violate any law, infringe intellectual property, or harass others.
• Resell, sublicense, or otherwise commercially exploit the Service except as expressly authorized by Aurum.

We may suspend or terminate accounts that violate this section. If you find a security issue, we welcome reports to support@aurumwealth.io.

Aurum stores the financial data you choose to enter — transactions, categories, budgets, and related notes. You own that data. By entering it into the Service, you grant us a limited, worldwide, royalty-free license to host, store, transmit, back up, and display it solely to operate and provide the Service to you.

We don’t use your data to train machine-learning models, sell it to third parties, or share it with advertisers. Our handling of personal information is described in our Privacy Policy.

You can export your data at any time from in-app settings, and you can request account deletion at any time. Account deletion permanently removes your data within 30 days, except where we’re required to retain certain records (for example, billing records for tax purposes).

The Service — including the software, design, copy, brand assets, and trademarks — is owned by Aurum and is protected by copyright and other intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose while your account is in good standing.

Nothing in these Terms transfers any ownership in the Service to you. You may not copy, modify, or create derivative works based on the Service except as expressly permitted.

You may stop using the Service at any time and cancel your subscription via in-app billing. If you cancel, access continues through the end of the period you’ve already paid for; we don’t prorate monthly plans.

We may suspend or terminate your account if you breach these Terms, if your account presents a security or fraud risk, or if a payment is unrecoverable after our standard retry process. We will give you reasonable notice where practicable.

The clauses that should reasonably survive termination — including the data, intellectual property, disclaimer, limitation of liability, indemnification, and governing-law sections — survive.

Aurum is a tool, not an advisor. The Service helps you record and visualize your own financial information. It does not provide investment, tax, legal, accounting, or other professional advice. The figures, projections, and visualizations the Service displays are based on the data you enter and are intended for informational purposes only.

Don’t make significant financial decisions based solely on output from Aurum. Where appropriate, consult a qualified professional.

The Service is provided “as is” and “as available”. To the maximum extent permitted by applicable law, Aurum disclaims all warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Aurum doesn’t warrant that the Service will be uninterrupted, error-free, or that any data will be preserved indefinitely. You’re responsible for keeping copies of any data you consider important. Some jurisdictions don’t allow exclusion of certain warranties, so parts of this section may not apply to you.

To the maximum extent permitted by law, Aurum will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to your use of the Service, even if Aurum has been advised of the possibility of such damages.

Aurum’s total aggregate liability for any claim arising out of or related to these Terms or the Service is limited to the greater of (a) the fees you paid Aurum in the 12 months immediately preceding the event giving rise to the claim, or (b) CAD $100.

Some jurisdictions don’t allow the limitation of certain damages; in those jurisdictions our liability is limited to the minimum permitted by law.

You agree to defend, indemnify, and hold harmless Aurum from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any law or third-party right.

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to its conflict-of-laws principles. The courts of Ontario have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service.

Before filing a formal claim, you agree to first reach out to support@aurumwealth.io so we have a chance to resolve the issue directly.

We may update these Terms from time to time. If a change is material, we’ll let you know by email or in-app notice at least 14 days before it takes effect. Continued use of the Service after the effective date means you accept the updated Terms. If you don’t agree, stop using the Service and cancel your subscription before the new Terms take effect.
